1. About Motorcurator
Motorcurator provides a community-focused platform for discovering, listing, and transacting in used vehicles and automotive products within trusted groups and registries. We facilitate connections and tools; unless expressly stated, we are not the seller, buyer, financier, insurer, or broker in transactions between users.
2. Eligibility
You must be at least 18 years old and capable of entering a binding contract under Indian law. You represent that information you provide is accurate and that you will comply with applicable laws, including motor vehicle, taxation, and consumer protection requirements.
3. Accounts and authentication
You are responsible for activity under your account and for maintaining the confidentiality of your login credentials. Notify us promptly at support@motorcurator.com if you suspect unauthorised access.
4. Community groups and listings
When using groups, feeds, listings, comments, or messaging features, you agree to:
- provide truthful, non-misleading information about vehicles, parts, and related products;
- respect group rules, privacy settings, and membership requirements;
- not post unlawful, defamatory, harassing, fraudulent, or infringing content;
- not scrape, spam, manipulate rankings, or interfere with platform security or performance.
We may review, moderate, restrict, or remove content or accounts that violate these Terms or harm other users or the platform.
5. Marketplace transactions
Transactions between users are primarily between the parties involved. You are responsible for verifying vehicle condition, ownership documents, RTO transfer requirements, payment terms, warranties, and legal compliance before completing a deal. Motorcurator does not guarantee the accuracy of listings or the conduct of users.
Any paid features, verification services, or third-party integrations may be subject to additional terms presented at the point of use.
6. Tools and informational content
Calculators, finders, blog posts, and other tools are provided for general information only. They do not constitute financial, legal, or professional advice. You should independently verify outputs and consult qualified professionals where needed.
7. Intellectual property
The Services, including branding, software, design, and content we create, are owned by Motorcurator or its licensors. You receive a limited, non-exclusive, revocable licence to use the Services for personal or internal business purposes in accordance with these Terms. You retain rights in content you submit, but grant us a licence to host, display, and distribute it as needed to operate the Services.
8. Prohibited conduct
You must not:
- use the Services for illegal activity or to misrepresent identity or vehicle details;
- attempt to access data or accounts without authorisation;
- upload malware or disrupt infrastructure;
- use automated means to extract data except as permitted by us in writing;
- circumvent fees, access controls, or safety features.
9. Third-party services
The Services may link to or integrate third-party sites and providers (for example, Google sign-in, analytics, or payment partners). Their terms and privacy practices apply to those services. We are not responsible for third-party content or conduct.
10. Disclaimers
The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed. We do not warrant uninterrupted or error-free operation.
11. Limitation of liability
To the maximum extent permitted by applicable law, Motorcurator and its affiliates, officers, and employees shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Services or user interactions. Our aggregate liability for direct damages shall not exceed the greater of INR 5,000 or the fees you paid us in the three months preceding the claim, except where liability cannot be limited under Indian law.
12. Indemnity
You agree to indemnify and hold harmless Motorcurator from claims, losses, and expenses (including reasonable legal fees) arising from your content, listings, conduct, or breach of these Terms or applicable law.
13. Suspension and termination
We may suspend or terminate access to the Services at any time for violation of these Terms, legal requirements, or risk to users or the platform. You may stop using the Services at any time. Provisions that by nature should survive termination will continue to apply.
14. Grievance redressal
In line with the Consumer Protection (E-Commerce) Rules, 2020 and related requirements, you may contact our grievance officer at support@motorcurator.com. We will acknowledge complaints within 48 hours and aim to resolve them within one month.
15. Governing law and disputes
These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction, subject to applicable consumer protection remedies that cannot be contracted away.
16. Changes
We may modify these Terms by posting an updated version on this page. Material changes will be indicated by the "Last updated" date. Continued use after changes become effective constitutes acceptance where permitted by law.
